Copyright notices and counter-notices

Designated agent

The designated agent is being registered with the U.S. Copyright Office. This page will show the agent's name and address as soon as the registration completes.

Sending a notice

Send a notice to the designated agent with all of the following. A notice that is missing one of them cannot be acted on until it is complete.

1. Your physical or electronic signature, or that of the person authorised to act for the copyright owner.
2. The copyrighted work you say is infringed, or a representative list if there are several.
3. Where the material is on ProjectCollab: the profile, listing, or kit link, and which piece. Enough for us to find it.
4. Your name, postal address, telephone number, and email address.
5. A statement that you believe in good faith the use is not authorised by the copyright owner, its agent, or the law.
6. A statement that the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for them.

These are the elements the United States Copyright Act (17 U.S.C. 512(c)(3)) sets out. Knowingly misrepresenting that material infringes can make the sender liable for the costs that follow.

What happens next

When a complete notice arrives, we remove or disable access to the material, record what was done, and tell the person who posted it, including your contact details so they can respond. If the material is embedded from another service, we disable the embed here; removal at its source is a matter for that service.

Removing a piece can affect a pending portfolio review or a profile's place in Discover. It does not decide who owns the work, and it changes nothing about payment for production work already done.

Counter-notices

If your material was removed and you believe that was a mistake or a misidentification, send the designated agent a counter-notice with:

1. Your physical or electronic signature.
2. The material that was removed and where it appeared before removal.
3. A statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification.
4. Your name, postal address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district (or, if outside the United States, for the district where ProjectCollab is located) and that you will accept service from the person who sent the notice.

We forward the counter-notice to the person who sent the notice. Unless they tell us within ten business days that they have filed a court action, we restore the material between ten and fourteen business days after receiving the counter-notice.

Repeat infringement

An account that repeatedly posts material it has no right to post is closed. Signed-in members can also report a profile from the profile itself with the reason Copyright; that report reaches the same staff queue.
